House prosecution submits resolution certifying articles of impeachment complied with Constitution

The House of Representatives prosecution panel has submitted to the impeachment court the resolution certifying that the impeachment complaint against Vice President Sara Duterte "fully complied" with the Constitution.

This is in complaince with the impeachment court's requirement for the House to certify to the non-violation of Art. XI, Section 3, paragraph 5 of the Constitution, which states that  "No impeachment proceedings shall be initiated against the same official more than once within the period of one year."

House prosecution also maintain that there is "no legal basis" for the return of the Articles of Impeachment forwarded to the Senate in accordance to the 1987 Constitution.

Additionally, it filed a re-submission of entry of apperance which lists the representatives serving in the prosecution panel.

The prosecution has also yet to give their answer to Duterte's response to her Senate impeachment trial summons. They have until June 30 in the afternoon to give their reply.

Duterte formally responded to the impeachment court's summons with an answer ad cautelam, or with caution. She said that the fourth impeachment complaint must be dismissed for violating the one-year prohibition on initiating impeachment.

"There are no statements of ultimate facts in the (impeachment complaint). Stripped of its 'factual' and legal conclusions, it is nothing more than a scrap of paper," the response read.

On June 10, the Senate voted to return the impeachment complaint to the House, without dismissing nor terminating the case until:

  • The House of Representatives certifies to the non-violation of Art. XI, Section 3, paragraph 5 of the Constitution, which provides that "No impeachment proceedings shall be initiated against the same official more than once within the period of one year"; including the circumstances on filing of the first three impeachment complaints
  • The House of Representatives of the 20th Congress communicate to the Senate that it is willing and ready to pursue the impeachment complaint against the Vice President.
